AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RM -6 TO CON -1, FOR <br />PROPERTY LOCATED ON THE EAST SIDE OF STATE ROAD AIA, JUST NORTH OF THE <br />TOWN OF INDIAN RIVER SHORES, AND DESCRIBED HEREIN, AND PROVIDING FOR <br />EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />The South 500 feet of Government Lot 3 as measured along the East right-of-way of State <br />Road AIA and lying East of said right-of-way in Section 25, Township 31 South, Range 39 <br />East. Together with the North 145.02 feet Government Lot 1 lying East of State Road AIA <br />right-of-way Section 36, Township 31 South, Range 39 East, all being and lying in Indian <br />River County, Florida. <br />Be changed from RM -6 to Con -1. <br />All <br />with <br />the meaning <br />and intent and <br />as set forth <br />and <br />described <br />in <br />said <br />Land Development <br />Regulations. <br />Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on <br />this 16"' day of March, 1999. <br />Effective <br />Date: <br />This <br />become <br />the <br />issuance <br />by the <br />State <br />Department <br />ordinance <br />shall <br />effective <br />upon <br />of Community <br />Affairs <br />of a Notice <br />of Intent to <br />find the <br />related <br />Comprehensive <br />Plan <br />Land <br />Use <br />Designation <br />Amendment <br />contained <br />in <br />Ordinance <br />99- 07 <br />in <br />compliance <br />in <br />accordance <br />with <br />s. <br />163.3184(9) <br />issuance <br />or the <br />of a <br />final order <br />by the <br />Administration <br />Commission <br />finding <br />the <br />in <br />referenced <br />amendment <br />compliance <br />with s. 163.3184(10). <br />Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on <br />this 16"' day of March, 1999. <br />
