THE CHAIRMAN THEN ASKED IF ANYONE PRESENT WISHED TO BE <br />HEARD. G. KENDALL SHARP, ATTORNEY REPRESENTING ROBERT A. CAIRNS <br />APPEARED WITH SITE PLANS OF SEA OAK DEVELOPMENT, A BEACHSIDE <br />COMMUNITY SOUTH OF THE WABASSO BRIDGE. <br />COMMISSIONER BOGOSIAN STATED HE MIGHT HAVE A CONFLICT <br />OF INTEREST AND ASKED ATTORNEY BURCH HIS OPINION. THE ATTORNEY <br />INFORMED THE BOARD THERE IS NO CONFLICT -OF INTEREST. <br />MR. CAIRNS STATED THAT THIS SEA OAK DEVELOPMENT WILL <br />HAVE A DENSITY OF EIGHT UNITS PER ACRE AND AN AGREEMENT REGARDING <br />SEWER AND WATER FACILITIES BEING TURNED OVER TO THE COUNTY WILL <br />BE PREPARED, <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />MASSEY, THE REQUEST FOR REZONING FROM AGRICULTURAL AND R-1 SINGLE <br />FAMILY DISTRICT TO R-2 MULTIPLE FAMILY DISTRICT BE DENIED. <br />COMMISSIONER DRITENBAS ABSTAINED FROM VOTING STATING HE <br />MIGHT HAVE A CONFLICT OF INTEREST. <br />ATTORNEY BURCH INFORMED THE'BOARD THAT COMMISSIONER <br />DRITENBAS DID NOT HAVE A CONFLICT OF INTEREST AND CANNOT ABSTAIN <br />FROM VOTING. <br />COMMISSIONER MASSEY I=XPLAINED THAT HIS REASON FOR DENYING THIS <br />ZONING CHANGE, IS THAT THE AREA CANNOT TAKE THIS DENSITY. <br />COMMISSIONER SIEBERT EXPLAINED THAT HIS REASON FOR DENYING <br />THIS ZONING CHANGE IS BASED ON THERE BEING INSUFFICIENT CONTROL <br />FOR THE FUTURE DEVELOPMENT OF THE PROPERTY. <br />CHAIRMAN Loy STATED THAT A ZONING CHANGE TO R-2 WAS <br />ADOPTED IN RESOLUTION N0. 72-44 DATED JUNE 21, 1972 ON THE <br />PROPERTY JUST NORTH AND SOUTH OF THIS PROPERTY BEING DISCUSSED <br />TODAY. AT THAT TIME MR. CAIRNS STATED HE WAS TRYING TO PURCHASE <br />THIS MIDDLE SECTION OF PROPERTY AND IF HE COULD ACCOMPLISH THIS <br />HE WOULD RETURN TO THIS BOARD FOR REZONING. <br />THE MOTION WAS REPEATED: "ON MOTION BY COMMISSIONER <br />SIEBERT, SECONDED BY COMMISSIONER MASSEY, THE REQUEST FOR REZONING <br />FROM AGRICULTURAL AND R-1 SINGLE FAMILY DISTRICT TO R-2 MULTIPLE <br />FAMILY DISTRICT BE DENIED".
