1. Acceptance of federal monies in the form of Community <br />Development Block Grant (CDBG) funds requires Indian River <br />County's certification that it has adopted and is enforcing a <br />policy which: <br />a. Prohibits the use of excessive force by law enforcement <br />agencies within its jurisdiction against any individuals <br />engaging in non-violent civil rights demonstrations; and <br />b. Enforces applicable State laws against physically barring <br />entrance (for reasons other than fire marshall occupancy <br />standards) or exit from a facility or location which is <br />the subject of such non-violent civil rights <br />demonstrations within its jurisdiction. <br />2. This requirement is based on Section 516 of Public Law 101-140 <br />more specifically known as "The 1990 HUD Appropriation Act" <br />and hereinafter known as "The Act" which mandates that each <br />local unit of government receiving CDBG funds must comply with <br />certain provisions of "The Act", among those provisions being <br />those aforestated in the above paragraph. <br />3. Indian River County is fully committed to protecting the <br />safety, welfare and civil rights of all residents of the <br />jurisdiction and wishes to comply with the terms and <br />conditions of "The Act" as required by the assurances of its <br />CDBG Award Agreement. <br />4. Local law enforcement personnel shall abide by this policy and <br />ensure the enforcement of State laws with regard to non- <br />violent civil rights demonstrations. The use of excessive <br />force against individuals engaged in these demonstrations is <br />prohibited. Agencies tasked with law enforcement functions <br />shall ensure that all personnel, regular or auxiliary, full- <br />time or part-time, are made aware of this commitment. <br />5. Additionally, law enforcement agencies shall ensure that pre- <br />planning occurs in conjunction with any scheduled or predicted <br />civil rights demonstration so that the prevention of the use <br />of excessive force is ensured in maintaining the non-violent <br />nature of such demonstrations. Included in this pre -planning <br />will be methodology to enforce applicable State laws against <br />physical barrier of entrances or exits from such <br />demonstrations. <br />6. This policy shall be included as an integral portion of all <br />applicable law enforcement operations manuals/handbooks and <br />will be included in training and courses of instruction for <br />law enforcement personnel. <br />/1T1'A4r�Ni' � <br />
