J/26/95 (ord\bingo-doc)Ow <br />ORDINANCE 95- 24 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, REGULATING THE HOLDING OF BINGO <br />GAMES IN INDIAN RIVER COUNTY. <br />WHEREAS, the state of Florida has set forth regulations for the <br />conduct of bingo games; and <br />WHEREAS, case law (Jordan Chapel vs. Dade County, 334 So.2d <br />661) has determined that local governments may regulate bingo games <br />provided such regulations do not conflict with state law; and <br />WHEREAS, it is in the public interest to regulate the number of <br />sessions that an organization may conduct bingo games, <br />COMMISSIONERS OF INDIAN RIVER COUNTY, that. <br />SECTION 1. AMENDMENT T. <br />read as follows <br />to <br />the Indian <br />River County Code to <br />A new section <br />306.11 <br />is added <br />. <br />read as follows <br />Any organization authorized by Florida Statutes to conduct <br />bingo games shall be limited to conducting said games to one <br />session per day and no more than two sessions per week in <br />Indian River County. No location may be used for bingo for <br />more than one session per day nor more than two sessions <br />per week in Indian River County. <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of <br />this ordinance is for any reason held to be unconstitutional, <br />inoperative, or void, such holding shall not affect the remaining <br />portions of this ordinance, and it shall be construed to have been the <br />Section 306.11. <br />Bingo Sessions <br />. <br />Any organization authorized by Florida Statutes to conduct <br />bingo games shall be limited to conducting said games to one <br />session per day and no more than two sessions per week in <br />Indian River County.
