a <br />recommendation of the IRCLHAProgram Review <br />Committee. <br />For housing units found to be chronic or repeat <br />non-compliance units, the IRCLHAProgram shall have <br />the authority to foreclose upon the housing units <br />and take possession of the units from the owner. <br />Chronic or repeat non-compliance shall be <br />considered more than two (2) non-compliance <br />findings in one year, or more than three (3) non- <br />compliance findings in two (2) years. <br />Assisted Housing Unit Resale <br />The resale of housing units assisted by the IRCLHAProgram <br />will require coordination with Indian River County, and <br />satisfaction of the first mortgage or subordinated first <br />mortgage held by Indian River County. <br />The resale of renter- and owner -occupied housing units <br />assisted by the IRCLHAProgram shall be subject to a <br />subsidy recapture provision substantially similar to that <br />specified in Section 143(m) of the United States Internal <br />Revenue Code of 1986. The amount of funds calculated by <br />application of the recapture provision shall be paid by <br />the selling household and redeposited into the Indian <br />River County Local Housing Assistance Trust Fund for <br />redistribution by the IRCLHAProgram. However, the <br />initial transfer of title for the assisted housing unit <br />between an eligible non-profit organization sponsor and <br />the eligible person(s) acquiring the unit via a lease - <br />purchase agreement shall not be considered the resale of <br />the unit requiring repayment of the loan amount, interest <br />amount and calculated recapture amount. <br />The Satisfaction of Mortgage shall be executed upon <br />payment of both the original loan/grant principal amount <br />and its accrued interest as required by the corresponding <br />IRCLHAProgram Assistance Strategy or Strategies, and the <br />determined subsidy recapture amount. <br />For owner -occupied housing units sold by the original <br />eligible persons receiving IRCLHAProgram assistance <br />selling the unit after a period of twenty (20) years, <br />repayment of both the principal loan amount and the <br />recapture amount shall be required, the interest amount <br />accrued on the loan shall not be collected. <br />For renter -occupied housing units which are offered for <br />sale by the eligible sponsor receiving IRCLHAProgram <br />assistance before termination of the 15 year <br />affordability period, or that have remaining mortgages <br />
