CHAPTER 1004. PUBLIC BUILDINGS DEVELOPMENT <br />Section 1004.01. Short title; statutory authority; applicability. <br />Section 1004.02. Findings. <br />Section 1004.03. Computation. <br />Section 1004.04. Use of funds. <br />Section 1004.01. Short title; statutory authority; applicability. <br />(1) This chapter shall be known and may be cited as the Indian River County Public <br />Buildings Development Impact Fee Ordinance. <br />(2) This chapter shall apply to the entire county, including the municipalities within the <br />county, to the extent permitted by Article VIII, § 1(f), Florida Constitution. <br />Section 1004.02. Findings. <br />In addition to those findings and determinations found in Chapter 1000, the board of county <br />commissioners makes the following findings and determinations: <br />(1) The existing public buildings are not sufficient to accommodate anticipated new <br />development without decreasing the existing levels of service. <br />(2) The public building level of service standard for the county is 1.99 building square feet <br />per capita for permanent plus weighted peak seasonal countywide population. <br />(3) Existing revenue sources are not sufficient to fund capital improvements necessary to <br />accommodate new development. <br />Section 1004.03. Computation. <br />The amount of the fees imposed by this chapter shall be determined by the fee schedule attached <br />as Appendix A to this title and incorporated by reference herein, or by the manner set forth in <br />subsection 1000.08(3). <br />Section 1004.04. Use of funds. <br />(1) All funds collected from public building development impact fees shall be used for the <br />purpose of capital improvements to public building development under the jurisdiction of the <br />Indian River County, under the jurisdiction of the county, and not for maintenance or operations. <br />Such acquisitions and improvements shall be those which are necessary to accommodate new <br />growth and development in the county. • <br />(2) Funds shall be used exclusively for capital improvements in the areas of Indian River <br />County from which the funds are collected. Funds shall be expended in the order in which they <br />are collected. <br />11 <br />
