ORDINANCE 2005- 015 <br />WHEREAS, the impact fees set forth in this title establish a fair and conservative <br />method of assessing new development its fair share costs for capacity producing capital <br />improvements; and <br />WHEREAS, the Board approves and accepts the underlying studies as‘ a <br />reasonable basis for the fees; and <br />WHEREAS, the impact fees set forth in this title will not fully pay for the costs of <br />capital improvements necessitated by new development, and the county recognizes that <br />the shortfall will have to come from other revenue sources; and <br />WHEREAS, the administrative charges set forth in this title are reasonable and <br />necessary charges in order to efficiently administer the duties mandated by this title. <br />NOW THEREFORE, BE IT ORDAINED by the Board of County Commissioners <br />of Indian River County, that Chapter 953 of the Indian River Code is hereby amended <br />as follows: <br />CHAPTER 953. FAIR SHARE ROADWAY IMPROVEMENTS Is repealed and <br />replaced by Chapter 1010, Indian River County Traffic Facilities and Fair Share <br />Roadway Improvements Ordinance, except to the extent necessary to implement traffic <br />impact fees under the exemption set forth in this ordinance. <br />NOW THEREFORE, BE IT FURTHER ORDAINED by the Board of County <br />Commissioners of Indian River County, that Title X of the Indian River Code is hereby <br />created as follows: <br />TITLE X <br />IMPACT FEES <br />CHAPTER 1000. PURPOSE AND INTENT <br />CHAPTER 1001. DEFINITIONS <br />CHAPTER 1002.. EMERGENCY SERVICES FACILITIES <br />CHAPTER 1003. CORRECTIONAL FACILITIES <br />CHAPTER 1004. PUBLIC BUILDINGS <br />CHAPTER 1005. LAW ENFORCEMENT <br />CHAPTER 1006. LIBRARY FACILITIES <br />CHAPTER 1007. SOLID WASTE FACILITIES <br />CHAPTER 1008. PARKS AND RECREATION FACILITIES <br />CHAPTER 1009. PUBLIC EDUCATION FACILITIES <br />CHAPTER 1010. TRAFFIC FACILITIES <br />CHAPTER 1011. ADMINISTRATIVE CHARGES <br />CHAPTER 1012. RULES OF CONSTRUCTION <br />CHAPTERS 1000 THROUGH 1012 ARE ATTACHED HERETO AND INCORPORATED <br />HEREBY <br />
