CHAPTER 1006. LIBRARY FACILITIES <br />Section 1006.01. Short title; statutory authority; applicability. <br />Section 1006.02. Findings. <br />Section 1006.03. Computation. <br />Section 1006.04. Use of funds. <br />Section 1006.01. Short title; statutory authority; applicability. <br />(1) This chapter shall be known and may be cited as the Indian River County Library <br />Facilities Impact Fee Ordinance. <br />(2) This chapter shall apply to the entire county, including the municipalities within the <br />county, to the extent permitted by Article VIII, § 1(f), Florida Constitution. <br />Section 1006.02. Findings. <br />In addition to those findings and det:2!a <br />rminatis found in Cr 1000, the board of county <br />commissioners makes the followingfindingsnd determina <br />(1) The existing library system inot te anticipated new <br />development without decreasing the existing levels of service. <br />(2) The library facilities level of service standard for the county is 580 square feet of library <br />space per 1,000 permanent plus weighted peak seasonal countywide population, 3,200 library <br />materials per 1,000 permanent plus weighted peak seasonal countywide population, 0.7 <br />computers per 1,000 permanent plus weighted peak seasonal countywide population, and 0.2 <br />other library equipment items per 1,000 permanent plus weighted peak seasonal countywide <br />population. <br />(3) Existing revenue sources are not sufficient to fund capital improvements necessary to <br />accommodate new development. <br />Section 1006.03. Computation. <br />The amount of the fees imposed by this chapter shall be determined by the fee schedule attached <br />as Appendix A to this title and incorporated by reference herein, or by the manner set forth in <br />subsection 1000.08(3). <br />Section 1006.04. Use of funds. <br />(1) All funds collected from the library facilities impact fees shall be used for the purpose of <br />capital improvements to library facilities under the jurisdiction of the county and not for <br />maintenance or operations. Such acquisitions and improvements shall be those which are <br />necessary to accommodate new growth and development in the county. <br />(2) Funds shall be used exclusively for capital improvements in the areas of Indian River <br />County from which the funds are collected. Funds shall be expended in the order in which they <br />are collected. <br />13 <br />
