CHAPTER 1007. SOLID WASTE FACILITIES <br />Section 1007.01. Short title; statutory authority; applicability. <br />Section 1007.02. Findings. <br />Section 1007.03. Computation. <br />Section 1007.04. Use of Funds. <br />Section 1007.01. Short title; statutory authority; applicability. <br />(1) This chapter shall be known and may be cited as the Indian River County Solid Waste <br />Facilities Impact Fee Ordinance. <br />(2) This chapter shall apply to the entire county, including the municipalities within the <br />county, to the extent permitted by Article VIII, § 1(f), Florida Constitution. <br />Section 1007.02. Findings. <br />In addition to those findings and determinations found in Chapter 1000, the board of county <br />commissioners makes the following findings and determinations: <br />(1) The existing solid waste facilities are not sufficient to accommodate anticipated new <br />development without decreasing the existing levels of service. <br />(2) The solid waste facilities level of service standard for the county is 2.2 tons or 3 67 cubic <br />yards per capita for permanent plus weighted peak seasonal countywide population per year. <br />(3) Existing revenue sources are not sufficient to fund capital improvements necessary to <br />accommodate new development. <br />Section 1007.03. Computation. <br />The amount of the fees imposed by this chapter shall be determined by the fee schedule <br />attached as Appendix A to this title and incorporated by reference herein, or by the manner set <br />forth in subsection 1000.08(3). <br />Section 1007.04. Use of funds. <br />(1) All funds collected from the Solid Waste Facilities impact fees shall be used for the <br />purpose of capital improvements to Solid Waste Facilities under the jurisdiction of the County <br />and not for maintenance or operations. Such acquisitions and improvements shall be those which <br />are necessary to accommodate new growth and development in the county. <br />(2) Funds shall be used exclusively for capital improvements in the areas of Indian River <br />County from which the funds are collected. Funds shall be expended in the order in which they <br />are collected. <br />14 <br />
