CHAPTER 1008. PARKS AND RECREATION FACILITIES <br />Section 1008.01. Short title; statutory authority; applicability. <br />Section 1008.02. Findings. <br />Section 1008.03. Computation. <br />Section 1008.04. Use of funds. <br />Section 1008.01. Short title; statutory authority; applicability. <br />(1) This chapter shall be known and may be cited as the Indian River County Parks and <br />Recreation Facilities Impact Fee Ordinance. <br />(2) This chapter shall apply to only unincorporated Indian River County. <br />Section 1008.02. Findings. <br />In addition to those findings and determinations found in Chapter 1000, the board of county <br />commissioners makes the following findings and determinations: <br />(1) The existing Parks and Recreation Facilities are not sufficient to accommodate <br />anticipated new development without decreasing the existing levels of service. <br />(2) The park and recreation level of service standard for the county is 6.61 acres per 1,000 <br />permanent plus weighted peak seasonal unincorporated county population. <br />(3) Existing revenue sources are not sufficient to fund capital improvements necessary to <br />accommodate new development. <br />Section 1008.03. Computation. <br />The amount of the fees imposed by this chapter shall be determined by the fee schedule attached <br />as Appendix A to this title and incorporated by reference herein, or by the manner set forth in <br />subsection 1000.08(3). <br />Section 1008.04. Use of funds. <br />(1) All funds collected from the Parks and Recreation Facilities impact fee shall be used for <br />the purpose of capital improvements to Parks and Recreation Facilities under the jurisdiction of <br />the County, and not for maintenance or operations. Such acquisitions and improvements shall be <br />those which are necessary to accommodate new growth and development in the county. <br />(2) Funds shall be used exclusively for capital improvements in the areas of Indian River <br />County from which the funds are collected. Funds shall be expended in the order in which they <br />are collected. <br />15 <br />
