ORDINANCE NO. 2007- 013 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, AMENDING AND RESTATING <br />PART III OF CHAPTER 201 OF THE CODE OF INDIAN RIVER <br />COUNTY, FLORIDA, PRETREATMENT REGULATIONS; PROVIDING <br />LEGISLATIVE FINDINGS; AMENDING SECTION 201.61 OF THE <br />CODE; PROVIDING FOR PURPOSE, APPLICABILITY, AND <br />ADMINISTRATION; ADOPTING DEFINITIONS; ESTABLISHING <br />CATEGORICAL PRETREATMENT REGULATIONS FOR USERS OF <br />THE WASTEWATER SYSTEMS OF INDIAN RIVER COUNTY; <br />ESTABLISHING STANDARDS FOR PROHIBITED DISCHARGES; <br />ESTABLISHING SPECIFIC LOCAL LIMITS ON DISCHARGE; <br />PROVIDING FOR PRETREATMENT OF WASTEWATER; PROVIDING <br />FOR THE ISSUANCE AND CANCELLATION OF WASTEWATER <br />DISCHARGE PERMITS; PROHIBITING CERTAIN DISCHARGES; <br />PROVIDING FOR DETERMINATIONS OF QUALITY AND QUANTITY <br />OF DISCHARGES; ESTABLISHING REPORTING REQUIREMENTS; <br />PROVIDING FOR COMPLIANCE MONITORING, ENFORCEMENT <br />PENALTIES, AND JUDICIAL ENFORCEMENT REMEDIES; PROVIDING <br />FOR AFFIRMATIVE DEFENSES TO DISCHARGE VIOLATIONS; <br />PROVIDING FOR RECODIFICATION OF SECTION 201.08(N) 1 AND 2 <br />OF THE CODE AS SECTION 201.92 RELATING TO INDUSTRIAL <br />DISCHARGE PERMIT AND RENEWAL FEES; AMENDING THE <br />TEMPERATURE AND PH PROVISIONS OF SUBSECTIONS A AND F <br />OF SECTION 201.30 OF THE CODE; PROVIDING FOR REPEAL OF <br />CONFLICTING ORDINANCES; PROVIDING FOR INCLUSION IN THE <br />CODE OF ORDINANCES OF INDIAN RIVER COUNTY; PROVIDING <br />FOR FILING WITH THE DEPARTMENT OF STATE; AND PROVIDING <br />AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, AS FOLLOWS: <br />PART I: AMENDED AND RESTATED PART III OF CHAPTER 201 OF THE CODE OF <br />INDIAN RIVER COUNTY, FLORIDA. <br />SECTION 1. LEGISLATIVE FINDINGS. <br />It is hereby ascertained, determined, and declared that: <br />(A) Pursuant to Article VIII, Section 1 of the Florida Constitution, and Sections 125.01 <br />and 125.66, Florida Statutes, the Board of County Commissioners has all powers of <br />local self-government to perform County functions and to render services in a manner <br />not inconsistent with general law and such power may be exercised by the enactment of <br />County ordinances. <br />1 <br />
