ORDINANCE NO. 2009-002 <br />site, other than land clearing, or filling or grading, in accordance with the <br />approved site plan, evidencing a good faith effort to diligently pursue <br />construction to completion in accordance with completion dates noted on <br />the approved plans. <br />SECTION 4, CODIFICATION <br />It is the intention of the Board of County Commissioners that the provision of this <br />ordinance shall become and be made part of the Indian River County Code, and that the <br />sections of this ordinance may be renumbered or re -lettered and the word ordinance may <br />be changed to section, article or such other appropriate word or phrase in order to <br />accomplish such intention. <br />SECTION 5, SEVERABILITY <br />If any section, sentence, clause, or phrase of this ordinance is held to be invalid <br />or unconstitutional by any court of competent jurisdiction, then said holding shall in no <br />way affect the validity of the remaining portions of this ordinance. <br />SECTION 6. EFFECTIVE DATE <br />This ordinance shall be effective and deemed filed when a certified copy has <br />been accepted by the postal authorities of the Government of the United States for <br />special delivery by certified mail to the Florida Department of State. <br />The Clerk to the Board shall mail the certified copy of the ordinance to the <br />Department of State as soon after enactment as practicable. <br />This ordinance was moved for adoption by Commissioner Solari, seconded by <br />Commissioner Wheeler, and adopted by the following vote: <br />Wesley S.
