ORDINANCE NO. 2005- 035 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE FUTURE <br />LAND USE ELEMENT OF THE COMPREHENSIVE PLAN BY CHANGING THE LAND <br />USE DESIGNATION FOR ±21.20 ACRES LOCATED SOUTH OF 35`h LANE AND <br />APPROXIMATELY 420 FEET EAST OF 12TH COURT FROM L-1, LOW-DENSITY <br />RESIDENTIAL -1 (UP TO 3 UNITS/ACRE), TO CII, COMMERCIAL INDUSTRIAL; AND <br />CHANGING THE LAND USE DESIGNATION FOR ±21.20 ACRES LOCATED <br />APPROXIMATELY 1350 FEET SOUTH OF 65TH STREET AND APPROXIMATELY 1100 <br />FEET WEST OF OLD DIXIE HIGHWAY, FROM CII, COMMERCIAL INDUSTRIAL, TO L- <br />1, LOW-DENSITY RESIDENTIAL -1 (UP TO 3 UNITS/ACRE); AND PROVIDING <br />CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners adopted the Indian River County <br />Comprehensive Plan on February 13, 1990, and <br />WHEREAS, the county received comprehensive plan amendment applications during its July <br />2004 amendment submittal window, and <br />WHEREAS, the Local Planning Agency held a public hearing on this comprehensive plan <br />amendment request on November 18, 2004, after due public notice, and <br />WHEREAS, the Local Planning Agency made a recommendation regarding this <br />comprehensive plan amendment to the Board of County Commissioners, and <br />• <br />WHEREAS, the Board of County Commissioners of Indian River County held a Transmittal <br />Public Hearing on May 10, 2005, after advertising pursuant to F.S. 163.3184(15)(b)1 and (c), and <br />WHEREAS, the Board of County Commissioners approved the transmittal of this <br />comprehensive plan amendment to the Florida Department of Community Affairs with a request <br />for review, and <br />WHEREAS, the Board of County Commissioners announced at the transmittal public hearing <br />its intention to hold and advertise a final public hearing at the adoption stage of this plan <br />amendment, and <br />WHEREAS, the Florida Department of Community Affairs received this Comprehensive Plan <br />Amendment on May 24, 2005, pursuant to F.S.163.3184(4), and <br />WHEREAS, Indian River County received the Objections, Recommendations and Comments <br />Report dated July 25, 2005, from the Florida Department of Community Affairs stating the <br />1 of <br />
