: <br />•. .. .. .... _ fir. <br />��' .. <br />F. <br />for the joint performance of these duties. <br />I answer the questions raised about Chapter 163 <br />in the following manner: <br />Chapter 163 is permissive only and not mandatory. <br />Florida Statute 163. 160(2) points out that it does not repeal or <br />modify any local or special act relating to zoning or planning; that <br />the provisions are supplemental and in addition to other powers held <br />by the governing body. Florida Statute 163.165 (3) states:A. <br />"Any governing body of any county or any incorporated <br />municipality may but shall not be required to, exercise <br />any of the powers set out in this part. " <br />In general, Chapter 163 provides authority for governing bodies to <br />{ <br />join together in planning only if they choose to bring themselves <br />under its provisions. Indian River County has not chosen to proceed <br />under this act, because ample authority for what it is doing in the .plan- <br />ning area may be found elsewhere, <br />Finally, I do not believe that the Vero Beach - Indian River <br />County Plkn i*+g Commission has any authority to do anything without <br />the concurrence of both the City Council and the Board of County <br />Commissioners. Everything this Planning Commission does is <br />approved by resolution by both the, City and County in advance. It is <br />a conduit by which the City and County perform a required function <br />of government at a considerable saving of money to the citizens,. both <br />City and County, of our area. - <br />In my opinion the questions raised by the property owners <br />associations are a result of their fears that a Master Plan will be - <br />adopted by the County and by the City without the input and considera- <br />tions of the citizens of the City and the County. This will not happen. <br />The first of many hearings on the proposed plan was held September <br />2, 1972, attended by most governmental and civic groups in the area. <br />Multiple meetings have been held by the County since that date to which <br />the public was invited and which were attended by representatives of <br />many. of the property owners associations who. are now questioning <br />JUL 181973 <br />eDo V fu 0 <br />a <br />= <br />
