ORDINANCE NO. 2005-048 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING INDIAN RIVER COUNTY CODE <br />CHAPTER 401, BUILDING CODES, TO ADOPT THE <br />FLORIDA BUILDING CODE; AND ADDING CHAPTER 403 <br />THE PROPERTY MAINTENANCE CODE; PROVIDING <br />FOR CODIFICATION; PROVIDING FOR SEVERABILITY; <br />AND PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the Florida legislature enacted the "Florida Building Codes Act" in <br />2001 to provide for uniform adoption, updating, amendment, interpretation, and <br />enforcement of a single, unified statewide building code; and <br />WHEREAS, the Florida Building Code is currently applied, administered, and <br />enforced uniformly and consistently in Indian River County; and <br />WHEREAS, the Florida Building Code is adopted and updated with new editions <br />every three years pursuant to Florida Statutes. Changes to the previous code include <br />addition of Residential and Existing Building Codes; and <br />WHEREAS, Chapter 401 of the Code of Indian River County currently adopts the <br />Florida Building Code and pursuant to state law, the County Code must now be <br />amended; and <br />WHEREAS, the Florida Building Commission recommends adoption of the <br />International Property Management Code which regulates the maintenance, repair or <br />demolition of structures; and <br />WHEREAS, the County currently has code enforcement regulations that govern <br />the exterior of structures but has no ordinances concerning maintenance of structures <br />that are enforced by the County Building Inspectors; and <br />WHEREAS, the health safety and welfare of the citizens of Indian River County <br />will be benefited by enacting an ordinance that requires building owners to maintain <br />their structures in a safe and sanitary manner. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that <br />SECTION 1. AMENDMENT. <br />Chapter 401. Building Codes, of the Code of Indian River County is hereby <br />amended to read as follows: <br />PART I.
