, <br />AUG 8 1973 <br />9 <br />ON MOTION BY COMMISSIONER DRITENBAS, SECONDED BY <br />COMMISSIONER SIEBERT, THE BOARD UNANIMOUSLY DENIED THE REQUEST <br />OF ROBERT I. GALE TO ABANDON THE ABOVE MENTIONED PROPERTY. THE <br />ADMINISTRATOR WILL INFORM MR. GALE THAT IT IS THE POLICY OF THIS <br />BOARD NOT TO ABANDON ANY PROPERTY UNTIL THE COUNTY SEWER AND WATER <br />SYSTEM HAS BEEN MAPPED OUT. <br />THE ADMINISTRATOR READ A LETTER FROM EUGENE WILMOTH <br />REQUESTING THE BOARD TO ABANDON THE UTILITY EASEMENT BETWEEN <br />LOTS 4 AND 5, BLOCK 2, AND LOTS 5 AND 6, BLOCK 2 IN HEALTHLAND <br />SUBDIVISION. <br />,ON MOTION BY COMMISSIONER BOGOSIAN, SECONDED BY <br />COMMISSIONER SIEBERT, THE BOARD UNANIMOUSLY APPROVED ABANDONING <br />THE SIDE LOT UTILITY EASEMENT BETWEEN LOTS 5 AND 6 AND BETWEEN <br />LOTS 4 AND 5, SUBJECT TO THE OWNER OF LOT 5 CONVEYING A SIX FOOT <br />DRAINAGE AND UTILITY EASEMENT TO THE COUNTY WITH THE NEW EASEMENT <br />LYING THREE FEET ON EITHER SIDE OF A- LINE DESCRIBED AS THE SOUTH <br />BOUNDARY OF THE NORTH 1/2 OF LOT 5 OR THE NORTH BOUNDARY OF THE <br />SOUTH HALF OF LOT 5 IN SAID BLOCK 2, -OF THE HEALTHLAND SUBDIVISION. <br />THE ADMINISTRATOR WAS INSTRUCTED TO WRITE MR, WILMOTH <br />INFORMING HIM.OF THE BOARDS DECISION AND TO INFORM HIM THAT THE <br />NECESSARY LEGAL PAPERS MUST BE DRAWN UP BY HIS ATTORNEY AND AT HIS <br />EXPENSE. <br />THE ATTORNEY WAS ADVISED TO PREPARE A POLICY STATEMENT <br />SO APPLICANTS CAN BE ADVISED OF THE PROCEDURE TO FOLLOW WHEN <br />APPLYING FOR ABANDONMENT OF A UTILITY EASEMENT AND THE PROCEDURE <br />TO FOLLOW AFTER RECEIVING APPROVAL FOR ABANDONMENT OF A UTILITY <br />EASEMENT. <br />COMMISSIONER BOGOSIAN STATED THAT THE ADMINISTRATOR , <br />SHOULD INFORM ALL POTENTIAL PETITIONERS THAT THE POLICY OF THE <br />BOARD, AT THIS TIME, IS NOT TO ABANDON ANY PROPERTY OTHER THAN UTILITY <br />EASEMENTS UNTIL,THE COMPLETION OF THE COUNTY -WIDE SEWER AND WATER <br />SYSTEM. <br />ATTORNEY BURCH INFORMED THE BOARD THAT HE HAS BEEN IN <br />CONTACT WITH BART COLLARD AND MR. TIERNEY, APPRAISORS, WHO ARE <br />WORKING ON APPRAISALS FOR THE COUNTY, AND THEY SHOULD HAVE THESE <br />APPRAISALS SOON. <br />--12-- <br />s¢P euox 17 PAc[316 <br />ry. <br />
