A U G 81973 <br />WATER EASEMENT <br />THIS WATER EASEMENT made this 4- day of August, A. D.. 1973, <br />by the COUNTY OF INDIAN RIVER, STATE OF FLORIDA, party of the <br />first part, and JOSEPHINE G. HARTFORD, party of the second part, <br />WITNESSETH: <br />That the party of the first part for and in consideration of the sum of <br />One Dollar ($1.00) to it in hand paid by the party of the second part, the <br />receipt whereof is hereby acknowledged, grants, bargains and sells unto <br />the party of the second part, a Water Easement including the right and privi- <br />lege of laying a water pipe from a pond owned by the party of the first part <br />hereinafter described to the land of the party of the second part, hereinafter <br />.. I <br />described, for the purposes of using the water in the pond for lawn and <br />shrubbery sprinkling only, the right of ingress and egress over the land of <br />the party of the first part for the purpose of keeping in repair the pipe as <br />aforesaid; <br />Land of Party of the First Part: <br />Lots 4, 5, 6, and the Southerly one-half of Lot 7, Block 3, of <br />Tropicolony, according to plat filed in the office of the Clerk <br />of the Circuit Court of Indian River County, Florida, in Plat <br />Book 3, page 48; said land lying and being in Indian River <br />County; Florida. <br />Land of Party of Second Part: <br />Lot 1, Block 3, of Tropicolony, according to plat filed in.the <br />office of the Clerk of Circuit Court of Indian River County, <br />Florida, in Plat Book 3, page 48; said land lying and being in <br />Indian River County, Florida. <br />The party of the first part reserves the right to revoke this Water Ease- <br />1 <br />went at any time on fifteen (15) days written notice. The party of the second <br />part by accepting this Water Easement agrees to use water from the pond 1 <br />only for the purpose above stated, agrees to never lower the natural level <br />I <br />of the water in the pond in excess of one inch, agrees to hold the party of the <br />first part harmless from any claim or liability by virtue of this Easement, <br />and agrees not to assign, grant or sell this Easement. <br />This Easement shall not run with the land. <br />IN TESTIMONY WHEREOF, and by virtue of authority vested by law in <br />the Board of County Commissioners, and for and on behalf of the County of <br />I• <br />--14-- <br />Qo� 17 PAA18 <br />
