2008- 023 Section 934.11 Pre -Existing Mining Operations The county recognizes that approved and permitted mining operations in existence prior to December 19, 2008 may continue as approved and permitted. Such mining operations, however, shall be subject to the following requirements of these mining regulations adopted December 9, 2008: (1) Annual mining permit requirements contained in section 934.07(4)(d). (a) Fees for annual mining permits established by resolution of the Board of County Commissioners, and (b) Security form requirements of section 934.07(5)(c) for any security substitutions. (2) Compliance and enforcement requirements of section 934.09. (3) Site restoration requirements of section 934.07(3)00. SECTION #10 Mining permit fees Section 934.12, is hereby amended to read as follows: Section 934.12. Mining permit fees. (1) The applicant for a mining permit shall be required to file a fees with the application in an amount te-be established by resolution of the board of county commissioners. (2) Permit renewal fees shall be one half (1 /2) the amount of the original fee. SECTION #11.: Extractive Uses section 971.22 is hereby amended to read as follows: (1) Mining (administrative permit) (a) Districts requiring administrative permit approval, (pursuant to the provisions of 971.04): A-1 A-2 A-3. (b) Criteria for mining operations: 1. A site plan meeting all iequirements of Chapter 9142;, and applicable requirements of Chapter 934; 2. A reclamation plan including littoral zone plan and water quality management plan, as applicable; 3.
