2008- 023 <br />1. All mining sites shall have direct access to a collector or arterial roadway or to a <br />574. No mechanical dewatering shall occur within one thousand (1,000) feet of any <br />platted subdivision that is not serviced by public water. <br />5. All mining sites shall be designated AG -1, AG -2, or AG -3 on the Future Land <br />Use Map. <br />6. At least 10 calendar days prior to the Planning & Zoning Commission and <br />Board of County Commissioner hearings at which the mining project request <br />is scheduled to be considered, a mailed courtesy notice shall be sent from the <br />county to owners of properties within '/Z mile of the mining site and owners of <br />properties that front on the road that serves as the proposed haul route for the <br />proposed mining operation. The cost of providing such notice shall be paid by <br />the applicant. <br />a. The Planning & Zoning Commission shall conduct its consideration of <br />the administrative permit request like a public hearing, allowing public <br />comment. <br />SECTION #12: SEVERABILITY. <br />If any clause, section or provision of this Ordinance shall be declared by a court of competent jurisdiction <br />to be unconstitutional or invalid for any cause or reason., the same shall be eliminated from this Ordinance <br />and the remaining portion of this Ordinance shall be in full force and effect and be as valid as if such <br />invalid portion thereof had not been incorporated therein. <br />SECTION #13: REPEAL OF CONFLICTING ORDINANCES. <br />The provisions of any other Indian River County ordinance that are inconsistent or in conflict with the <br />provisions of this Ordinance are repealed to the extent of such inconsistency or conflict. <br />SECTION #14: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. <br />The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of <br />Indian River County, Florida.
