ORDINANCE 2005- 017 <br />approval, the previously described special regulations for new major development shall apply. The <br />area of development for such projects shall be the area of the site containing buildings, additions, <br />structures, facilities or improvements proposed by the applicant or required to serve those items <br />proposed by the applicant. As an example, a small building addition that requires additional parking <br />spaces would result in a project area of development/redevelopment that includes the addition AND <br />the parking lot addition and adjacent required landscape areas. <br />(14) Non -conformities: Within the corridor area, legally established existing development and <br />uses that do not comply with these special regulations are grandfathered -in under the countywide <br />nonconformities regulations of LDR Chapter 904. All nonconforming uses and structures are <br />governed by the LDR Chapter 904 regulations. <br />In addition, within the corridor area the following non -conformities regulations shall <br />apply: <br />(a) Nonconforming property: It is the intent of this chapter to allow nonconforming <br />properties to continue, but also to encourage their conformity to what shall be <br />referred to as a "compatible property." A "compatible property" shall be considered <br />in compliance with the intent of the corridor special regulations. <br />(b) Continuance of nonconforming property: A nonconforming property may be <br />continued, subject to the following provisions: <br />1. Use of nonconforming structures abandoned for a period of twelve (12) or <br />more consecutive months (cross-reference LDR section 904.08) located on a <br />nonconforming property shall not be permitted until the property is brought <br />into compliance with the requirements of a compatible property. <br />2. Except as otherwise provided herein, there may be a change of tenancy or <br />ownership of a nonconforming property, without the loss of nonconforming <br />status, if use of the nonconforming structures is not abandoned for a period of <br />twelve (12) or more consecutive months. <br />3. Colors of a structure located on a nonconforming property shall not be <br />changed from those existing at the time of the adoption of these special <br />regulations, unless the new, to -be -painted colors comply with the SR 60 <br />special color regulations. <br />4. Projects on nonconforming properties requiring a building permit (excluding <br />permits for roofs or minor repairs) shall be required to bring the property into <br />compliance as a "compatible property." <br />5. A structure located on a nonconforming property shall not be enlarged or <br />increased in any way from its lawful size at the time of the adoption of these <br />special regulations.
