public health, welfare and safety, when in fact said pending <br />petitions will actually be detrimental to the public health, <br />welfare and safety, in that they will cause an increased burden <br />on public sewer, waterand electrical facilities; that they will. <br />cause an increase on other public facilities such as hospitals, <br />schools, libraries and recreation buildings and locations; that <br />most of the pending petitions will affect the beach area of Vero <br />Beach, Florida, which is serviced by one main roadway known as <br />A -l -A which is only a two-lane road and which is already over- <br />burdened with existing traffic and that none of.these pending pe- <br />titions have been studied or considered in reference to the impact <br />on the local citizens who live, or taxpayers owning property, in <br />the Vero Beach area, and that most of the above -listed plaintiffs <br />are residents of the Vero Beach area, having their homes or other <br />property located in the area in the vicinity of the above -listed <br />projects and they will be adversely affected by any changes in <br />zoning which will increase the density particularly wheare an overall <br />master plan has not yet been approved and adopted by Indian River. <br />County, Florida. <br />(3) The granting of the above petitions would constitute <br />spot zoning inasmuch as the proposed comprehensive master plan, <br />although completed, has not been approved by the public for adoption <br />by the County Commission of Indian River County, Florida. <br />(4) The proposed rezoning, if they should be adopted, would <br />be arbitrary and discriminatory as to the other property otmers in <br />Indian River County, Florida, and particularly as to the property <br />owners in Vero Beach area and said proposed changes would be. <br />unlawful and unconstitutional. <br />WHEREFORE, plaintiffs pray as follows: <br />(1) That this Court enter a temporary order enjoining the <br />defendant from approving said rezoning applications, and any and <br />I <br />Page Eleven. <br />- 33 - <br />AUG 2 21973 <br />7 ?Aa' <br />J00 <br />
