i <br />i - <br />1 <br />10 <br />} <br />prepare and make recommendations for a comprehensive master <br />i <br />plan for controlling growth in,the City and County, and that on . <br />i l . <br />F <br />or .about September of 1972, said planning consultants presented <br />. their recommendations to elected and appointed officials of the <br />City and County. <br />(6) That some.of the aforesaid -procedures and actions were <br />i <br />j not in compliance with the Florida Interlocal Cooperation Act of <br />.i . <br />1969, particularly Part II thereof; that the County has no other <br />i <br />pre-existing authority to jointly engage in any such activities <br />1 4 <br />nor to jointly expend.local and/or Federal tax funds thereon; and <br />j that, in any event, the County, by jointly entering inco funding <br />{ agreements with the State -of Florida has elected de facto to <br />f proceed under the provisions of said Act. <br />WHEREFORE, plaintiffs pray as follows: <br />(1) That a Final Judgment be entered declaring that the <br />6 County is obliged or has otherwise -elected to comply with the pro- <br />visions of Chapter 163, Florida Statutes and that they shall comply <br />j S <br />therewith, in the further development, adoption and implementation <br />of a comprehensive masterjplan for controlling future growth ix. and <br />throughout the Countiy. �. <br />DATED. this 17th day of August, 1973. <br />i <br />JEROME F. •KRANER, ARTHUR S.
