ORDINANCE 2004-030 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING LAND <br />DEVELOPMENT REGULATIONS (LDRS) CHAPTER 952, TRAFFIC. <br />WHEREAS, the citizens of Indian River County, the Board of County Commissioners and <br />the Planning and Zoning Commission have raised concerns about providing turn lanes at access <br />points to new developments; and <br />WHEREAS, the Metropolitan Planning Organization commissioned a study to examine <br />whether requiring left turn lanes at access points would improve the flow of traffic; and <br />WHEREAS, the study revealed that the addition of left turn lanes at access points to <br />developments would improve traffic flow; and <br />WHEREAS, the Metropolitan Planning Organization's Technical Advisory Committee and <br />the Citizen's Advisory Committee, the Professional Services Advisory Committee and the Planning <br />and Zoning Commission have all approved the study and recommended adoption of this ordinance <br />amendment; <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA THAT THE INDIAN RIVER COUNTY LAND DEVELOPMENT <br />REGULATIONS (LDRS) BE AMENDED AS FOLLOWS: <br />1. A portion of Chapter 952.12(1)(h)1 Access Control is hereby amended to read as <br />follows: <br />Ingress left -turn lane requirements* <br />A twelve -foot wide left -turn lane with appropriate storage and transition shall be provided at each <br />driveway • - - - .. ... ..• •! - . when the <br />average annual daily traffic (AADT) volume projected at the time of project buildout and peak hour <br />left -turn rates meet the following thresholds: <br />Projected AADT Volume <br />Less than 8,000 <br />8,000-9,000 <br />9,001 — 10, 000 <br />More than 10,000 <br />Peak Hour Left Turns <br />35 or more <br />30 or more <br />25 or more <br />20 or more <br />2. Repeal of Conflicting Provisions <br />All previous ordinances, resolutions, or motions of the Board of County Commissioners of Indian <br />River County, Florida which conflict with the provisions of this ordinance are hereby repealed to <br />the extent of such conflict. All special Acts of the legislature• applying only to the unincorporated <br />portion of the Indian River County which conflict with the provisions of this ordinance are hereby <br />repealed to the extent of such conflict. <br />3. Codification <br />Coding: Words in strike -through type are deletions from existing law.
