ORDINANCE 2006- 024 <br />• Identify appeal/variance procedure or a prohibition of <br />appeals/variances <br />• Identify a monitoring program which shall be <br />administered by public agencies or private organizations <br />qualified to provide or assist with workforce or affordable <br />housing. <br />The alternative shall be considered by the Planning and Zoning <br />Commission and evaluated under the above criteria. The PZC is <br />authorized to approve the alternative and attach conditions to <br />ensure that the above criteria are satisfied. <br />C. The maximum size of each dwelling unit shall be restricted in <br />perpetuity to 1,500 sq. ft. under air. <br />D. The restrictions reauired under items A or B, and C above shall <br />be incorporated into deed restrictions, running in favor of the <br />county and any unit buyer or renter, approved by the County <br />Attorney and filed in the public records by the project applicant. <br />The sales price restriction shall require county consent of the <br />sales price prior to each closing during the 10 -year restriction <br />period. Such consent is authorized to be made by the Community <br />Development Director or his designee. <br />SECTION #2: SEVERABILITY. <br />If any clause, section or provision of this Ordinance shall be declared by a court of competent <br />jurisdiction to be unconstitutional or invalid for any cause or reason, the same shall be eliminated <br />from this Ordinance and the remaining portion of this Ordinance shall be in full force and effect and <br />be as valid as if such invalid portion thereof had not been incorporated therein. <br />SECTION #3: REPEAL OF CONFLICTING ORDINANCES. <br />The provisions of any other Indian River County ordinance that are inconsistent or in conflict with <br />the provisions of this Ordinance are repealed to the extent of such inconsistency or conflict. <br />SECTION #4: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. <br />The provisions of this Ordinance shall become. and be made a part of the Code of Laws and <br />Ordinances of Indian River County; Florida. The sections of the Ordinance may be renumbered or <br />relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or <br />any other appropriate word. <br />SECTION #5: EFFECTIVE DATE. <br />This Ordinance shall take effect immediately upon filing with the Department of State. <br />Bold Underline: Additions to Ordinance <br />Stfike *>1..,,ag : Deleted Text from Existing Ordinance <br />FACommunity Development\Users\CurDev\ORDINANCE\2006\2006- 971.41(9) small lot.RTF <br />
