ORDINANCE 2004-041 <br />3. CHAPTER 926, LANDSCAPE AND BUFFER REGULATIONS, IS HEREBY AMENDED BY REVISING <br />SECTION 926.03, APPLICABILITY, AND BY ADDING SECTION 926.15, SINGLE-FAMILY LOT <br />DEVELOPMENT CANOPY TREE REQUIREMENTS, AS FOLLOWS: <br />Section 926.03. Applicability. <br />The provisions of this 'chapter shall apply to the development and maintenance of property in the unincorporated area of <br />Indian River County which is subject to the provisions of Chapter 914, Site Plan Regulations; Chapter 915, Planned <br />Development; and Chapter 913, Subdivisions and Plats, of the County Land Development Code. Section 926.15 of this <br />chapter shall apply to the development and maintenance of property in the unincorporated area of the County that is <br />subject to the provisions of Chapter 912 Single -Family Development of the County Land Development Code <br />Section 926.15. Single-family lot development canopy tree requirements. <br />(1) Two canopy trees as defined in Chapter 901 shall be planted or preserved on single-family lots in conjunction <br />with lot development Said trees are required to be planted or preserved prior to County issuance of a certificate of <br />occupancy for the residence. This requirement of two canopy trees shall not apply to any single-family lot where an initial <br />building permit application for home construction was submitted prior to March 14 2005 (the effective date of this <br />ordinance) Planted canopy trees shall be of a size quality and type as specified in Section 926.06 of this chapter. CHAPTER 912, SINGLE-FAMILY DEVELOPMENT, SUBSECTION 912.07(6), IS HEREBY AMENDED TO <br />READ AS FOLLOWS. <br />(6) Tree protection, tree removal, and land clearing, and. landscape regulations.
