ORDINANCE NO, 2007. 038 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />TEXT OF THE COMPREHENSIVE PLAN'S CAPITAL IMPROVEMENTS <br />ELEMENT; AND PROVIDING SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners adopted the Indian River <br />County Comprehensive Plan on February 13, 1990, and <br />WHEREAS, F.S. 163.3177(3)(b)1 requires an annual review and update of the <br />County's Capital Improvements Element; and <br />WHEREAS, F.S. 163.3187(1)(f) allows the County, by ordinance, to amend its <br />capital improvements element annually once per year outside of the standard twice a <br />year amendment limitation threshold and do so through only one adoption public <br />hearing; and <br />WHEREAS, the Board of County Commissioners of Indian River County <br />advertised for a Public Hearing to Consider Adopting an Ordinance Amending the <br />Capital Improvements Element of the Comprehensive Plan, pursuant to F.S. <br />163.3184(15)(b)(1) and (c); and <br />WHEREAS, the Board of County Commissioners of Indian River County held <br />an Adoption Public Hearing on November 13, 2007, at which parties in interest and <br />citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida, that: <br />SECTION 1. Financial Feasibility <br />The Board of County Commissioners finds that the proposed amendment of the <br />Capital Improvements Element is financially feasible. <br />SECTION 2. Comprehensive Plan Amendment Adoption and Transmittal <br />The amendment to the Indian River County Comprehensive Plan identified in <br />Section 3 is hereby adopted, and three (3) copies are directed to be transmitted to the <br />State of Florida Department of Community Affairs and one (1) copy is directed to be <br />transmitted to the Treasure Coast Regional Planning Council. <br />1 of 3 <br />
