2007- 036 <br />Prohibited plant Speeie� Exotic species removal. For all new development, or redevelopment of <br />existing property, the applicant is required to remove, under county environmental supervision, all <br />invasive, exotic plant species defined and listed in Appendix B prior to issuance of a certificate of <br />occupancy or certificate of completion, whichever is applicable. <br />(6) Prohibitive plantings The following is a list of prohibited plants that shall not be planted <br />within any landscape areas: <br />Cattley Guava <br />Common Guava <br />Loqua <br />Rose Apple <br />Surinam Cherry <br />Orange Jasmine <br />Chinese Box Orange <br />(7) Exceptions. Governmental institutions or other research centers under contract with <br />governmental agencies conducting Scientific research are exempt from any regulations prohibiting <br />the planting of Caribbean fruit fly and citrus greening host plants Any group utilizing this <br />exemption must verify their status with the Community Development Department <br />SECTION #3: SEVERABILITY. <br />If any clause, section or provision of this Ordinance shall be declared by a court of competent jurisdiction <br />to be unconstitutional or invalid for any cause or reason, the same shall be eliminated from this Ordinance <br />and the remaining portion of this Ordinance shall be in frill force and effect and be as valid as if such <br />invalid portion thereof had not been incorporated therein. <br />SECTION #4: 12EPEAL OF CONFLICTING ORDINANCES. <br />The provisions of any other Indian River County ordinance that are inconsistent or in conflict with the <br />provisions of this Ordinance are repealed to the extent of such inconsistency or conflict. <br />SECTION #5: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. <br />The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of <br />Indian River County, Florida.
