-j <br />ORDINANCE # 2003 -- 018 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CG <br />TO PD FOR THE PROPERTY LOCATED ON THE SOUTH SIDE OF STATE <br />ROAD 60, WEST OF 82ND AVENUE DESCRIBED HEREIN AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, on April 24, 2003, the Planning and Zoning Commission, sitting as the local <br />planning agency on such matters, held a public hearing and subsequently made a recommendation <br />regarding this rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida to -wit: <br />LEGAL DESCRIPTION <br />PARCEL 3: <br />INDIAN RIVER FARMS COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK <br />2, PAGE 25 IN ST. LUCIE COUNTY, FLORIDA BEING THE SOUTH 290.00 FEET OF <br />THE WEST 260 FEET OF TRACT 10, SECTION 2, TOWNSHIP 33 SOUTH, RANGE 38 <br />EAST AS RECORDED IN O.R.B. 109, PAGE 11 OF THE PUBLIC RECORDS OF <br />INDIAN RIVER COUNTY, FLORIDA; AND <br />PARCEL 4: <br />INDIAN RIVER FARMS COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK <br />2, PAGE 25 IN STL LUCIE COUNTY, FLORIDA. BEING THE WEST 260.00 FEET OF <br />TRACT 10, LESS THE NORTH 820 FEET AND LESS THE SOUTH 290 FEET OF <br />TRACT 10, SECTION 2, TOWNSHIP 33 SOUTH, RANGE 38 EAST AS RECORDED IN <br />O.R.B. 109, PAGE 11 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, <br />FLORIDA <br />Be changed from CG, General Commercial to PD (Planned Development). <br />All with meaning and intent as set forth and described in said land development regulations, <br />and the attached approved conceptual PD plan. <br />The provisions of this ordinance shall become effective upon filing with the Department of <br />State. <br />
