-j ORDINANCE # 2003 -- 018 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CG TO PD FOR THE PROPERTY LOCATED ON THE SOUTH SIDE OF STATE ROAD 60, WEST OF 82ND AVENUE DESCRIBED HEREIN AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, on April 24, 2003, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida to -wit: LEGAL DESCRIPTION PARCEL 3: INDIAN RIVER FARMS COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK 2, PAGE 25 IN ST. LUCIE COUNTY, FLORIDA BEING THE SOUTH 290.00 FEET OF THE WEST 260 FEET OF TRACT 10, SECTION 2, TOWNSHIP 33 SOUTH, RANGE 38 EAST AS RECORDED IN O.R.B. 109, PAGE 11 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA; AND PARCEL 4: INDIAN RIVER FARMS COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK 2, PAGE 25 IN STL LUCIE COUNTY, FLORIDA. BEING THE WEST 260.00 FEET OF TRACT 10, LESS THE NORTH 820 FEET AND LESS THE SOUTH 290 FEET OF TRACT 10, SECTION 2, TOWNSHIP 33 SOUTH, RANGE 38 EAST AS RECORDED IN O.R.B. 109, PAGE 11 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA Be changed from CG, General Commercial to PD (Planned Development). All with meaning and intent as set forth and described in said land development regulations, and the attached approved conceptual PD plan. The provisions of this ordinance shall become effective upon filing with the Department of State.
