ORDINANCE NO. 2006- 0 -37 - <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR t 3.52 ACRES LOCATED <br />SOUTH OF CR 510 AND APPROXIMATELY 272 FEET EAST OF 46TH AVENUE, FROM <br />CG, GENERAL COMMERCIAL DISTRICT TO OCR, OFFICE, COMMERCIAL, <br />RESIDENTIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND <br />EFFECTIVE DATE <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River . County, Florida, did <br />i <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with -'the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which`aparties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County,. Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />A PORTION OF LAND IN SECTION 28, TOWNSHIP 31, TOWNSHIP 39 EAST, INDIAN <br />RIVER COUNTY, FLORIDA, WHICH IS MORE PARTICULARLY DESCRIBED AS <br />FOLLOWS: <br />COMMENCE AT THE INTERSECTION OF THE EASTERLY RIGHT-OF-WAY LINE OF <br />SUNRISE AVENUE AND THE SOUTHERLY RIGHT-OF-WAY LINE OF WABASSO <br />ROAD; THENCE RUN N00°10'52"W ALONG THE EXTENSION OF THE EASTERLY <br />RIGHT-OF-WAY LINE OF SUNRISE AVENUE A DISTANCE OF 56.28 FEET TO <br />INTERSECT WITH THE CENTERLINE OF WABASSO ROAD, THE CENTERLINE OF A <br />100 -FOOT WIDE RIGHT-OF-WAY; THENCE RUN N45009'39"E ALONG THE <br />AFORESAID CENTERLINE OF WABASSO ROAD A DISTANCE OF 271.72 FEET TO A <br />Pagel of 3 <br />
