• <br />ORDINANCE NO. 2005- 043 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR +/- 32 54 ACRES <br />LOCATED WITHIN THE INDIAN RIVER TWIN ESTATES, MOBILE VILLA AND INDIAN <br />RIVER ACRES SUBDIVISIONS FROM RMH-8, RESIDENTIAL MOBILE HOME DISTRICT <br />(UP TO 8 UNITS/ACRE), TO ROSE -4, ROSELAND RESIDENTIAL DISTRICT (UP TO 4 <br />UNITS/ACRE); AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE <br />DATE <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />5 <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />THAT PART OF LOT 7 AND THE SOUTH 109.6 FEET (MEASURED DUE NORTH AND <br />SOUTH) OF LOT 8 OF J.A. HUDSON SUBDIVISION AS RECORDED IN DEED BOOK EE, <br />PAGE 600, OF BREVARD COUNTY PUBLIC RECORD, LYING EAST OF OLD DIXIE <br />HIGHWAY; EXCEPT HOWEVER, THAT PART OF LOT 7 DESCRIBED AS BEGINNING AT A <br />POINT OF INTERSECTION OF THE CENTERLINE OF OLD DIXIE HIGHWAY AND THE <br />SOUTH LINE OF SAID LOT '7; THENCE IN A NORTHEASTERLY DIRECTION TO A POINT <br />ON THE SHORE OF INDIAN RIVER WHICH POINT IS 24FT.
