ORDINANCE NO. 2004- 012 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM A-1 TO PD RESIDENTIAL <br />FOR APPROXIMATELY 30.80 ACRES AND APPROVING THE PD CONCEPTUAL PLAN FOR <br />THE SUBJECT SIVE LOCATED AT THE SOUTHWEST CORNER THE MAIN RELIEF CANAL <br />AND 58TH AVENUE; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFLCTIVE <br />DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has deteniiined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />THE FOLLOWING PARCELS OF LAND, SITUATE IN PORTIONS OF <br />SECTION 5 AND 8, TOWNSHIP 33 SOUTH, RANGE 39 EAST, INDIAN <br />RIVER COUNTY, FLORIDA, BEING PARTICULARLY DESCRIBED AS <br />FOLLOWS: PARCEL A: BEGINNING AT THE SOUTHWEST CORNER OF <br />THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID <br />SECTION 5, TOWNSHIP 33 SOUTH, RANGE 39 EST, THENCE NORTH TO <br />THE SOUTH RIGHT-OF-WAY LINE OF THE MAIN CANAL OF THE <br />INDIAN RIVER FARMS COMPANY; THENCE EASTERLY ALONG THE <br />SAID CANAL RIGHT-OF-WAY LINE TO THE WEST RIGHT-OF-WAY LINE <br />OF CANAL OF THE SIAD INDIAN RIVER FARMS COMPNAY, KNOWN <br />AND PLATTED AS LATERAL `B', THENCE SOUTH ALONG THE RIGHT- <br />OF-WAY OF THE SAID LATERAL `B' TO THE SECTION LINE DIVIDING <br />SECTION 5 AND SECTION 8; THENCE WEST TO THE POINT OF <br />BEGINNING; LESS AND EXCEPT THE WEST 56 FEET OF THE EAST 136 <br />F:\Co:mnunity Development\Users\CurDev\ORDINANCE\Segovia Lakes PD ordinance.doc 1 <br />
