ORDINANCE NO. 2005- 016 <br />AN ORDINANCE OF INDIAN RIVER COUNTY FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RS -3, SINGLE-FAMILY <br />RESIDENTIAL DISTRICT (UP TO 3 UNITS/ACRE), AND RS -1, SINGLE-FAMILY <br />RESIDENTIAL DISTRICT (UP TO 1 UNIT/ACRE), TO PD, PLANNED DEVELOPMENT <br />DISTRICT, AND APPROVING THE CONCEPTUAL PLAN FOR APPROXIMATELY 38.88 <br />ACRES OF LAND GENERALLY LOCATED ON THE NORTH SIDE 63RD STREET, EAST OF <br />US HIGHWAY 1 AND DESCRIBED HEREIN, AND PROVIDING FOR AN EFFECTIVE DATE <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 11, <br />TOWNSHIP 32 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA. <br />is changed RS -3, single-family residential (up to 3 units per acre) and RS -1, single-family residential <br />(up to 1 unit per acre) to PD, planned development, with the layout as depicted in the attached <br />conceptual PD plan (Exhibit "A"). The site's zoning shall automatically revert to the prior RS -1 and <br />RS -3 zoning if no land development permit for the PD project is issued on or before May 17, 2008. <br />Al'wrth{'the mean>ng;.and' intent and as set forth and described in said Land Development <br />Regulations.
