ORDINANCE NO. 2002- 012 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR 142 ACRES, LOCATED AT THE NORTHEAST CORNER OF 85TH STREET AND 90TH AVENUE, FROM A -I TO RS- A; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described properties situated in Indian River County, Florida, to -wit: THE EAST 89.19 ACRES OF THE SOUTHWEST 1/4 OF SECTION 26, TOWNSHIP 31 SOUTH, RANGE 38 EAST, SAID PARCEL LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. LESS RIGHTS OF WAY AND EASEMENTS OF RECORD, THE WEST 38.31 ACRES OF THE EAST 127.5 ACRES OF THE SOUTHWEST'/4 OF SECTION 26, TOWNSHIP 31 SOUTH, RANGE 38 EAST, SAID PARCEL LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. LESS RIGHTS OF WAY AND EASEMENTS OF RECORD, THE WEST 17.60 ACRES OF THE EAST 145.1 ACRES OF THE SOUTHWEST %4 OF SECTION 26, TOWNSHIP 31 SOUTH, RANGE 38 EAST, SAID PARCEL LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. LESS RIGHTS OF WAY AND EASEMENTS OF RECORD, are changed from A-1, Agricultural District (up to 1 unit/ 5 acres), to RS -3, Single Family Residential District (up to 3 units/acre).
