N <br />ORDINANCE NO. 2000-001 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM <br />RS -3 AND A4 TO PD FOR APPROXIMATELY 191.64 ACRES OF LAND <br />GENERALLY LOCATED NEAR THE NORTHEAST CORNER OF 58TH <br />AVENUE SW AND 9TH STREET SW (OSLO ROAD) BETWEEN 9TH STREET <br />SW AND THE SOUTH RELIEF CANAL; AND DESCRIBED HEREIN, AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is <br />consistent with the Comprehensive Plan of Indian River County and the county land development <br />regulations, including but not limited to the Planned Development (PD) Process and Standards for <br />Development chapter; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the Zoning of the property situated in Indian River County, and legally <br />described in EXHIBIT A (attached) be changed from RS -3 and A -I to PD, residential with accessory <br />commercial, and that the PD conceptual plan (see EXHIBIT B, attached) will control and regulate <br />development on the subject land. <br />mmordwitrus.ord <br />
