JAN ' y-7 <br />THIS BOND WAS RECEIVED AND IS BEING MADE A PART OF <br />THE OFFICIAL RECORDS AND FILED IN THE OFFICE OF THE CLERK <br />OF THE CIRCUIT COURT. <br />:• ID <br />KNOW ALL MEN BY THESE PRESENTS, that CONE BROTHERS CONTRACTING <br />COMPANY, hereinafter referred to as CONTRACTOR, as Principal, and FEDERAL <br />INSURANCE COMPANY, State of New York, hereinafter called SURETY, as <br />Surety are held and firmly bound unto the BOARD OF COUNTY COMMISSIONERS, <br />INDIAN RIVER COUNTY, FLORIDA, as Obligee in the full and just sum of <br />FOURTEEN THOUSAND AND NO/100----($14,000.00)DOLLARS, lawful money of <br />the United States of America, to the payment of which sum, well and <br />truly to be made, the CONTRACTOR and SURETY bind themselves, their and <br />each of their heirs, executors, administrators, successors and assigns, <br />jointly and severally firmly by these presents. <br />WHEREAS, the CONTRACTOR has received Mining Permits from the OBLIGEE <br />to mine fill material from the following locations within the boundaries <br />of Indian River County, Florida: Tract 10, Sec. 10, T33S, R38E; Tracts <br />9 and 10, Sec. 23, T33S, R38E; Tract 5, Sec. 25, T33S, R38E; Tracts 3, <br />4, 5 and 6, Sec. 36, T33S, R38E. <br />NOW, THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, that for <br />each of the above land areas that the CONTRACTOR restores in accordance <br />with Indian River County Ordinance 71-3, Indian River Zoning Ordinance <br />September 8, 1971, Section 4-B(2), and any revisions effective as of <br />this date, this obligation shall be reduced by THREE THOUSAND FIVE <br />HUNDRED AND NO/100---- ($3,500.00)DOLLARS, being totally void when all <br />four tracts are restored, otherwise to remain in full force and effect. <br />r. <br />Signed, sealed and dated this the 9th day of January 1974. <br />Witness <br />CONE BROTHERS CONTRACTING COMPANY <br />Principal <br />Vice President <br />FEDERAL INSURANCE COMPANY <br />Attorney -in -Fact <br />- 74 - �oox 19 pw23.4 <br />
