ORDINANCE NO. 2009- 0 p R <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND ZONING MAP FOR ±32 ACRES LOCATED AT THE NORTHWEST <br />CORNER OF INDIAN RIVER BOULEVARD AND 37TH STREET FROM RM -8, MULTI- <br />FAMILY RESIDENTIAL DISTRICT -1 (UP TO 8 UNITS PER ACRE), TO OCR, OFFICE, <br />COMMERCIAL, RESIDENTIAL DISTRICT; AND PROVIDING CODIFICATION, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian <br />River County, Florida that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />COMMENCE AT A RAILROAD SPIKE REPORTED TO BE THE SOUTH 1/4 CORNER OF <br />SECTION 25, TOWNSHIP 32 SOUTH, RANGE 39 EAST, AND RUN ALONG THE SECTION <br />LINE N 89 44'309'E 686.49 FEET TO A POINT; THEN RUN N 0003'30" W PARALLEL WITH <br />THE WEST LINE OF THE SE 1/4 OF SAID SECTION 55.00 FEET TO THE NORTH LINE OF <br />BARBER STREET (37TH STREET) AND POINT OF BEGINNING; THEN RUN N 00 03'X9 W <br />167.10 FEET TO A POINT; THEN RUN S 44 56' 05" E 234.99 FEET TO A POINT IN THE <br />NORTH LINE OF BARBER STREET; THEN RUN ALONG THE NORTH LINE S 89 44'30" W <br />165.81 FEET TO THE POINT OF BEGINNING. <br />SUBJECT TO ALL EASEMENTS, RIGHTS OF WAY, RESERVATIONS AND RESTRICTIONS, IF ANY. <br />F:\Community Development\Users\LONG RANGE\CompPlan Amendments`Small Scale Amendments\WM Gregory Construclion\Ordinance <br />REZONE.docPage 1 of 3 <br />
