ORDINANCE NO, 2009- 015 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA <br />AMENDING TITLE X, IMPACT FEES, OF THE CODE OF INDIAN <br />RIVER COUNTY TO REVISE APPENDIX A, IMPACT FEE RATE <br />SCHEDULE; AND AMENDING CODE SECTION 1000.06 <br />"IMPOSITION" TO PROVIDE AN EXCEPTION TEMPORARILY <br />SUSPENDING FOR SIX MONTHS THE IMPOSITION OF IMPACT <br />FEES FOR EMERGENCY SERVICES FACILITIES, <br />CORRECTIONAL FACILITIES, PUBLIC BUILDINGS, LAW <br />ENFORCEMENT, AND SOLID WASTE FACILITIES; AND, <br />PROVIDING FOR CODIFICATION; SEVERABILITY; AND <br />EFFECTIVE DATE, <br />WHEREAS, Community Development Department staff prepared a 2009 <br />Impact Fee Update Report, incorporating the most recent data on trip lengths <br />and credits from the 2007 Duncan Impact Fee Update Report and incorporatingq <br />the most recent trip rate data from the Institute of Traffic Engineers (ITE) 8t <br />Edition Traffic Impact Fee Manual; and <br />WHEREAS, the Board of County Commissioners, at its meeting of August <br />18, 2009, approved the county's 2009 Impact Fee Update Report; and <br />WHEREAS, the Board of County Commissioners directed staff to revise <br />the county's impact fee rate schedule consistent with 2009 Impact Fee Update <br />Report; and <br />WHEREAS, the Board of County Commissioners of Indian River County, <br />Florida, finds that the dramatic downturn of the local economy warrants <br />measures to stimulate the local economy, and <br />WHEREAS, the Board of County Commissioners temporarily suspended 5 <br />impact fees from April 1, 2009 until September 30, 2009; and <br />WHEREAS, the Board of County Commissioners, at its meeting of August <br />187 2009, decided to extend the temporary impact fee suspension for another six <br />months until March 31, 2010. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />1 <br />
