3. Penalty <br />Any person who takes or harvests a land crab within the unincorporated area) of <br />Indian River County, Florida, or who intentionally kills or intentionally injures a land crab <br />within the unincorporated area of Indian River County, Florida, shall be guilty of a county <br />ordinance violation, punishable by a fine not to exceed $500 or by imprisonment in the <br />county jail not to exceed 60 days or by both such fine and imprisonment, as provided in <br />Section 125.69, Florida Statutes. <br />4, Severability <br />If any section, paragraph, sentence, clause or phrase of this ordinance is held by <br />a court of competent jurisdiction to be invalid or unconstitutional, such holding shall not <br />affect the validity of the remaining portions of this ordinance. <br />5. Codification <br />It is the intention of the Board of County Commissioners that the provisions of this <br />ordinance shall become and be made a part of The Code of Indian River County, and that <br />the sections of this ordinance may be renumbered or relettered, and the word 'ordinance" <br />may be changed to "section," "article," or such other appropriate word or phrase in order <br />to accomplish such intention. <br />6.
