PLb-1c AQd'r;nj 711110 <br />5/00(legal\ord\firearms)0w <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />ESTABLISHING REGULATIONS CONCERNING THE <br />DISCHARGE OF FIREARMS. <br />WHEREAS, the State has regulated the discharge of firearms in public <br />(Section 790.15, F.S.); and <br />WHEREAS, said regulations, among other things, prohibit the discharge <br />of firearms over or on the right-of-way of any paved public roads; and <br />WHEREAS, Indian River County has a number of unpaved roads in <br />developed areas; and <br />WHEREAS, it is in the public health, safety and welfare to afford this <br />protection to persons in the vicinity of unpaved roads, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT. <br />The <br />Indian <br />River County <br />Code is hereby amended by <br />the addition <br />of a <br />Firearms. <br />Chapter <br />306 the Indian River County <br />Code to <br />new Section <br />306.13 <br />to <br />of <br />read as <br />follows: <br />It is unlawful for any person to discharge a firearm on or over <br />the right-of-way of any public road, highway or street in Indian <br />River County whether paved or unpaved. This section does not <br />apply to a person lawfully defending life or property or performing <br />official duties requiring the discharge of a firearm or to a person <br />discharging a firearm on public roads or properties expressly <br />approved for hunting by the Fish and Wildlife Conservation <br />Commission or Division of Forestry. <br />SECTION 2.
