NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: <br />PART I: AMENDED AND RESTATED PART I: GENERAL PROVISIONS OF <br />CHAPTER 204 OF THE CODE OF INDIAN RIVER COUNTY, FLORIDA. <br />SECTION ONE: FINDINGS. <br />It is hereby ascertained, determined and declared that: <br />A. Pursuant to Article VIII, Section 1 of the Florida <br />Constitution, and Sections 125.01 and 125.66, Florida Statutes, the <br />Board has all powers of local self-government to perform County <br />functions and to render services in a manner not inconsistent with <br />general law and such power may be exercised by the enactment of <br />County ordinances. <br />Be The Board has heretofore. created the Indian River <br />County Solid Waste Disposal District, a dependent special district <br />of Indian River County, as set forth in Section 1 of Ordinance 91- <br />6, which is codified in Sections 204.20, .21, .22, and .23 of the <br />County Code. <br />C. Regulation of the collection and disposal of Solid <br />Waste within the County by the Board and the District serves a <br />public purpose, and promotes and protects the health, safety, and <br />welfare of the citizens of Indian River County. <br />D. Pursuant to Section 125.01(1)(k)2, Florida Statutes, <br />the Board has the authority to enter into Franchise Agreements for <br />the collection and disposal of Solid Waste within the County, and <br />the Board also has the power to grant the same authority to the <br />District. <br />E. The requirements and standards created by this <br />Ordinance are necessary and appropriate to protect the health, <br />safety, and welfare of the citizens of Indian River County. <br />
