D. No Franchise shall be renewed by the District Board <br />or the County Administrator or the County Administrator's designee <br />unless the District Board or the County Administrator or the County <br />Administrator's designee, as applicable, makes a determination that <br />such renewal complies with the requirements for a new Franchise. <br />SECTION SIXTEEN: FRANCHISE TRANSFERS. <br />A. Any Franchise issued hereunder shall be a privilege <br />which is personal to the Franchisee and such Franchise shall not be <br />sold, transferred, leased, assigned or disposed, in whole or in <br />part, either by sale, merger, consolidation or otherwise, without <br />the prior consent of the District Board, and then only under such <br />conditions as the District Board may prescribe. <br />Be Any request for transfer or assignment of a <br />Franchise shall be made in writing and shall include a signed <br />statement by the transferee confirming that the transferee accepts <br />and will comply with all of the terms and conditions of the <br />Franchise. <br />Co The District Board is under no obligation to consent <br />to a transfer or assignment of any Franchise. <br />D. The District Board's consent to a transfer or <br />assignment of a Franchise shall not be granted until the District <br />Board has examined the proposed transferee's legal, financial, <br />technical, and other qualifications and confirmed that the <br />transferee satisfies the requirements that apply to a new <br />Franchisee. <br />SECTION SEVENTEEN: REVOCATION OF FRANCHISES. <br />A. Any Franchise may be subject to revocation by the <br />District Board upon an affirmative finding of the District Board <br />that the Franchisee has failed or refused to comply with the <br />requirements of this Ordinance, the County Code, the Franchise <br />Agreement, or any applicable law. <br />
