also include -,s -Solid wW_aste from unimproved real property of any <br />size and improved real property of more than one acre. <br />SECTION TWO: AMENDMENTS TO SECTION 204.31 <br />After the effective date of this Ordinance, the following <br />subsection codified in Section 204.31 of the County Code shall be <br />I <br />mended as follows: <br />204.31 (a) Permit required. Each pPerson transporting <br />7Special wWaste to the District 'Landfill shall be required to <br />obtain a permit from the dDistrict to dispose of the material at <br />the District �Landfill. Notwithstanding the foregoing, a Person <br />conveying Construction and Demolition Debris to the District's <br />Landfill must obtain a Franchise, as set forth in this. Ordinance, <br />but does not need to obtain a permit under this section 204.31 of <br />the Countv Code. <br />PART III: GENERAL PROVISIONS. <br />SECTION ONE: SEVERABILITY. <br />If any clause, section or provision of this Ordinance <br />shall be declared by a court of competent jurisdiction to be <br />unconstitutional or invalid for any cause or reason, the same shall <br />be eliminated from this Ordinance and the remaining portion of this <br />Ordinance shall be in full force and effect and be as valid as if <br />such invalid portion thereof had not been incorporated therein. <br />SECTION TWO: REPEAL OF CONFLICTING ORDINANCES. <br />Part One of the existing Indian River County Solid Waste <br />Disposal District Ordinance, Chapter 204 of the County Code, is <br />hereby repealed in its entirety. The provisions of any other <br />Indian River County ordinance that are inconsistent or in conflict <br />with the provisions of this Ordinance are repealed to the extent of <br />such inconsistency or conflict. <br />SECTION THREE: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. <br />The provisions of this Ordinance shall become and be made <br />a part of the Code of Laws and Ordinances of Indian River County, <br />Florida. The sections of the Ordinance may be renumbered or <br />relettered to accomplish such, and the word "ordinance" may be <br />ion", "article", or any other appropriate word. <br />changed to."sect <br />
