ORDINANCE NO. 2012- 032 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND ZONING MAP FOR APPROXIMATELY ± 19171.45 ACRES OWNED BY THE ST. JOHNS RIVER WATER MANAGEMENT DISTRICT (SJRWMD) (±531.68 ACRES LOCATED SOUTH OF CITY OF FELLSMERE AND 3 '/2 MILES NORTH OF S.R. 60, AND ±639.77 ACRES LOCATED 1 '/2 MILES NORTH OF S.R. 60 AND 3 MILES WEST OF I-95)9 FROM A-2, AGRICULTURAL -2 DISTRICT (UP TO 1 UNIT /10 ACRES), TO CON49 CONSERVATION -1 DISTRICT (ZERO DENSITY); AND TO REZONE ±350 ACRES OWNED BY INDIAN RIVER COUNTY LOCATED WEST OF BLUE CYPRESS LAKE AND APPROXIMATELY 6 '/Z MILES NORTH OF S.R. 60, FROM A-3, AGRICULTURAL -3 DISTRICT (UP TO 1 UNIT/20 ACRES), TO CON49 CONSERVATION4 DISTRICT (ZERO )ENSITY); AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners held a public hearing pursuant to this rezoning request, at which part ies in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that: The zoning of the following described property situated in Indian River County, Florida, to wit: Property 1 FELLSMERE FARMS CO SUB TRS 1100 TO 1114 LESS N 55 FT & LESS E 2.8 A OF TR 1107 THE ABOVE DESCRIBED PREMISES CONTAIN 531.68 ACRES, MORE OR LESS. SUBJECT TO ALL EASEMENTS, RIGHT-OF-WAY OF RECORD, CONDITIONS AND RESTRICTIONS AS CONTAINED WITHIN THE CHAIN OF TITLE.
