TRIPARTITE AGREEMENT <br />,THIS TRIPARTITE AGREEMENT entered. into between the CITY <br />OF VERO BEACH, FLORIDA, hereinafter referred to as "City", INDIAN <br />RIVER COUNTY, FLORIDA, hereinafter referred to as "County", and <br />THE INDIAN RIVER COUNTY HOSPITAL DISTRICT, hereinafter referred <br />to as "Hospital", <br />WITNESSETH: <br />WHEREAS, the City and County entered into an Agreement dated <br />January 11, 1973, a copy of which is attached hereto as Exhibit "A", and <br />WHEREAS, the City, County and Hospital desire to enter into a <br />Tripartite Agreement as required under the January ll, 1973, Agreement <br />for the purpose of allowing the City to temporarily provide water service <br />to the Hospital during construction of the new hospital, 'the site of which <br />lies in the County service area, and <br />WHEREAS, by entering into this Tripartite Agreement, all <br />parties agree as follows: <br />1. All parties agree the Hospital must have temporary water <br />service during construction of the new Hospital. <br />2. All parties agree that the- County cannot provide -said <br />temporary water service at this time and only the City can provide said <br />j <br />service. <br />3. The City agrees to provide said temporary water service <br />to the new Hospital site, the legal description of which is shown on Exhibit <br />"B" attached hereto. <br />4. City and Hospital shall by agreement set the terms and <br />conditions for said temporary water service and the County hereby agrees <br />to the same. M <br />5.
