BLOCK STATED THAT IF THE BOARD APPROVES THE <br />FRANCHISE AND DIRECTS US TO INCLUDE THIS AREA DESCRIBED BY <br />ATTORNEY SMITH, WE WILL DO S0, <br />ATTORNEY SMITH REQUESTED THAT THE PROPOSED RESOLUTION <br />AS SUBMITTED BY THE APPLICANT BE AMENDED TO PROVIDE THAT <br />PARAGRAPH B OF SECTION 2 BE CHANGED SO THAT IT WILL STATE <br />"SUBDIVISION" IS A GRANTEE OF THE RIGHT UNDER THIS FRANCHISE - <br />TO WIT: LOWELL LOHMAN, 918 GREENWAY LANE, VERO BEACH, RICHARD <br />A. DICE, HAZEL DITTRICH AND IRVING M. SILVERMAN. <br />HEPBURN WALKER OF ST. CHRISTOPHER BEACH APPEARED <br />REQUESTING THAT THE 12 LOTS IN THIS AREA BE INCLUDED IN THE <br />WATER FRANCHISE. <br />THE BOARD INFORMED MR. WALKER THAT AN AFFIDAVIT OF <br />CONSENT SIGNED BY ALL THE PROPERTY OWNERS IN ST, CHRISTOPHER'S <br />BEACH MUST BE PRESENTED BEFORE THESE CAN BE CONSIDERED IN <br />.THIS WATER FRANCHISE. <br />ATTORNEY BURCH RETURNED TO THE MEETING. <br />GEORGE WELLINGTON SMITH, A RESIDENT OF ST. CHRISTOPHER'S <br />BEACH APPEARED OBJECTING TO A SEWER TREATMENT PLANT BEING <br />INSTALLED ON THE PROPERTY DESCRIBED. MR. SMITH LIVES SOUTH <br />OF WHERE THE TREATMENT PLANT WILL BE LOCATED AND OUTSIDE <br />OF THE 300 FEET FROM THE PLANT ITSELF. <br />MR, SMITH OBJECTS TO THIS TREATMENT, PLANT AS IT IS <br />IN VIOLATION OF DEED RESTRICTIONS. <br />ATTORNEY BURCH INFORMED THE BOARD THAT THE DEED <br />RESTRICTION IS A MATTER THAT IS BETWEEN MR. GEORGE WELLINGTON <br />SMITH AND SEMINOLE SHORES SUBDIVISION. <br />THE BOARD THEN DISCUSSED THAT PORTION OF THE FRANCHISE <br />REQUIREMENTS WHICH STATE THAT ALL EASEMENTS EXCEPT THE <br />TREATMENT PLANT AND THE SITE FOR THE SAME WILL BE TURNED OVER <br />TO THE COUNTY AND QUESTIONED IF THE DEVELOPERS OF THE TREATMENT <br />PLANT WOULD HAVE ANY OBJECTION TO DONATING THIS PLANT TO THE <br />COUNTY AND THE COUNTY TAKING IT OVER AT THEIR OPTION. <br />MR, LOHMAN, DEVELOPER OF THIS SYSTEM, STATED T14AT <br />HE WOULD NOT HAVE ANY OBJECTIONS TO THE COUNTY TAKING OVER THE <br />-11}- <br />APR0 1974 � 000K f19 FAcf �2Q <br />l <br />4 <br />
