' -3- <br />the remainder of the term for the account of the Lessee, and recover from the <br />Lessee at the end of the term or at the time each payment of rent comes due <br />under this lease, as the Lessors may choose, the difference.between the rent <br />specified in the lease and the rent received on the re-leasing or renting. <br />In either event, the Lessors shall also recover all expenses incurred by <br />reason of the breach, including reasonable attorney's fees. <br />12. REMEDIES FOR BREACH OF AGREEMENT: If either Lessors or Lessee shall <br />fail to perform or shall breach any agreement of. this lease other than the <br />agreement of the Lessee to pay rent, for ten (10) days after written notice <br />specifying the performance required shall have been given to the party failing <br />to perform, the party so giving notice may institute action in a court of <br />r <br />competent jurisdiction to terminate this lease or to compel performance of the <br />agreement, and the prevailing .party..in that...litigation shall be paid by the <br />dosing party all expenses of such litigation, including a reasonable attorney's <br />fee. <br />13. TERMINATION OF LEASE: -This lease shall be terminated immediately if <br />the Lessee shall be dissolved, become insolvent or bankrupt, or make an assign- <br />ment for the benefit of creditors. <br />{ <br />14: UTILITIES: The Lessee is to pay all light and other utility charges, <br />including expense of air conditioning operations which may be due and payable <br />against the property leased herein. Water shall be furnished at the expense <br />of the Lessor. <br />15. OPTION TO RELEASE: The Lessee shall have the option to re -lease the <br />premises subject to negotiations at time of renewal.
