<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
<br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING,
<br />ABANDONMENT, VACATION, AND DISCONTINUANCE OF A TWENTY FOOT
<br />WIDE RIGHT-OF-WAY PORTION ALONG THE WEST SIDE OF 27TH AVENUE
<br />SW LYING NORTH OF 6TH STREET SW IN EMERSON VILLAS RESERVING A
<br />DRAINAGE AND UTILITY EASEMENT OVER THE EAST 10 FEET OF RIGHT-
<br />OF-WAY, SAID LAND LYING IN INDIAN RIVER COUNTY, FLORIDA
<br />WHEREAS, on April 11, 2006, Indian River County received a duly executed and documented
<br />petition from George Sigler of Vero Beach, requesting that the County close, vacate, abandon,
<br />discontinue, renounce and disclaim any right, title and interest of the County and the public in and to a
<br />twenty foot wide right-of-way portion along the west side of 27th Avenue SW north of 6th Street SW as
<br />shown on the plat of Emerson Villas subdivision and recorded in Plat 3, Page 52 of Indian River
<br />County, Florida, said lands now lying and being in Indian River County, Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to consider
<br />said petition was duly published; and
<br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and
<br />report, and testimony of all those interested and present, the board finds that the subject right-of-way is
<br />not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary
<br />for continuity of the County's street and thoroughfare network, nor access to any given private property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
<br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
<br />1. All right, title and interest of the County and the public in and to that certain right-of-way more
<br />particularly described as follows:
<br />THE WEST 20 FEET OF THE EAST 100 FEET OF SECTION 22, TOWNSHIP 33
<br />SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA, LYING
<br />IMMEDIATELY EASTERLY OF AND CONTIGUOUS WITH LOTS 4 AND 5,
<br />BLOCK A, EMERSON VILLAS SUBDIVISION, AS RECORDED IN PLAT BOOK 3,
<br />PAGE 52 OF THE RECORDS OF INDIAN RIVER COUNTY, FLORIDA, SAID
<br />PARCEL BEING BOUNDED ON THE NORTH BY THE EASTERLY EXTENSION
<br />OF THE NORTHERLY LINE OF SAID LOT 4 AND ON THE SOUTH BY THE
<br />EASTERLY EXTENSION OF THE SOUTHERLY LINE OF SAID LOT 5.
<br />SAID PARCEL CONTAINING 0.06 ACRES MORE OR LESS.
<br />is hereby forever closed, abandoned, and vacated, except that a utility and drainage easement is
<br />expressly reserved for utility and drainage purposes, over the east 10 feet of right-of-way. (See
<br />Exhibit "A", attached.)
<br />2. The closing, vacation, abandonment, of this public right-of-way is in the best interests of the
<br />public.
