<br />RESOLUTION 2009- 158
<br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
<br />COUNTY, FLORIDA, PROVIDING FORTHE CLOSING, ABANDONMENT, VACATION
<br />AND DISCONTINUANCE OF A SEGMENT OF 12TH PLACE SW BETWEEN US
<br />HIGHWAY I AND I ST AVENUE SW, SAID LAND LYING IN INDIAN RIVER COUNTY,
<br />FLORIDA
<br />WHEREAS, on June 23, 2009, hrdian River County received a duly executed and documented
<br />petition from Mark Montgomery et al, requesting that the County close, vacate, abandon, discontinue,
<br />renounce and disclaim any right, title and interest of the County and the public in and to the portion of a
<br />segment of 12i1' Place SW between US Highway 1 and I st Avenue SW in Indian River County, Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336. 10, notice of a public hearing to consider said
<br />petition was duly published; and
<br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and report,
<br />and testimony of all those interested and present, the Board finds that the subject right-of-way is not a state or
<br />federal highway, is not part ofa municipality, nor is said right-of-way necessary for continuity of the County's
<br />street and thoroughfare network, nor access to any given private property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
<br />INDIAN RIVER COUNTY, FLORIDA that:
<br />All right, title and interest of the County and the public in and to that certain right-of-way more
<br />particularly described as follows:
<br />THE 70 FOOT RIGHT OF WAY KNOWN AS OBISPO STREET ON THE PLAT OF
<br />GRANADA GARDENS, UNIT NO. 1, AS RECORDED IN PLAT BOOK 3, PAGE 91, ALSO
<br />SHOWN AS AN UNNAMED STREET ON THE PLAT OF RIVER SHORES ESTATES UNIT
<br />ONE, AS RECORDED IN PLAT BOOK 7, PAGE 32 SAID RIGHT OF WAY BEING MORE
<br />PARTICULARLY DESCRIBED AS FOLLOWS:
<br />COMMENCING AT THE SOUTHEAST CORNER OF BLOCK E, GRANADA GARDENS,
<br />UNIT NO. 1, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 3,
<br />PAGE 91, THENCE NORTH 00'51'35" WEST ALONG THE WEST RIGHT OF WAY OF
<br />MADRID AVENUE AS SHOWN ON SAID PLAT OF GRANDADA GARDENS, UNIT
<br />NO. I, A DISTANCE OF 123.70 FEET TO THE SOUTH RIGHT OF WAY OF OBISPO
<br />STREET AND THE POINT OF BEINGINNING; THENCE SOUTH 88'05'27" WEST
<br />ALONG THE SOUTH RIGHT OF WAY LINE OBISPO STREET A DISTANCE OF 292.10
<br />FEET TO THE EAST RIGHT OF WAY OF US HIGHWAY 1 AND A POINT ON A CURVE
<br />CONCAVE TO THE EAST AND HAVING A RADIUS OF 11,347.20 FEET; THENCE
<br />NORTHERLY 73.31 FEET ALONG SAID CURVE AND EAST RIGHT OF WAY LINE OF
<br />US HIG14WAY 1 THROUGH A CENTRAL ANGLE OF 0'22'13" TO THE NORTH RIGHT
<br />OF WAY LINE OF OBISPO STREET; THENCE NORTH 88'05'27" EAST ALONG THE
<br />NORTH RIGHT OF WAY LINE OBISPO STREET A DISTANCE OF 315.19 FEET TO THE
<br />WEST RIGI IT OF WAY OF LINE MADRID AVENUE; THENCE SOUTH 00'51'35" EAST
<br />A DISTANCE OF 70.00 FEET TO THE POINT OF BEGINNING. SAID PARCEL
<br />CONTAINING 215254 SQUARE FEET OF 0.49 ACRES MORE OR LESS 2024261
