<br />INDIAN RIVER COUNTY, FLORIDA -I
<br />WHEREAS, on October 7, 2009, Indian River County received a duly executed and
<br />documented petition from Bruce Barkett, Esquire on behalf of 510 LLC, requesting that the County
<br />close, vacate, abandon, discontinue, renounce and disclaim any right, title and interest of the County
<br />and the public in and to a segment of 86th Street (Palm Blvd) lying between CR510 and 47th Avenue
<br />(Tropical Avenue) adjacent to Blocks 8 and 9 of Weona Park, as shown in Plat Book 2, Page 17 of the
<br />Public Records of Indian River County, Florida, said lands now lying and being in Indian River County,
<br />Florida; and
<br />WHEREAS, in accordance with Florida Statutes 336. 10, notice of a public hearing to consider
<br />said petition was duly published; and
<br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and
<br />report, and testimony of all those interested and present, the Board finds that the subject right-of-way is
<br />not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary
<br />for continuity of the County's street and thoroughfare network, nor access to any given private property.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
<br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
<br />1. All right, title and interest of the County and the public in and to those certain right-of-way
<br />segments more particularly described as follows:
<br />-WAY
<br />A PARCEL OF LAND BEING A PORTION OF WEONA PARK ACCORDING TO
<br />THE PLAT THEREOF AS RECORDED IN PLAT BOOK 2, PAGE 17 OF THE
<br />PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA, SAID PARCEL
<br />BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS,
<br />BEGIN AT THE INTERSECTION OF THE EAST RIGHT OF WAY LINE OF 47TH
<br />AVENUE (TROPICAL AVENUE) AND THE SOUTH RIGHT OF WAY LINE OF
<br />86TH STREET (PALM BOULEVARD) AS SHOWN ON THE PLAT OF WEONA
<br />PARK AS RECORDED IN PLAT BOOK 2, PAGE 17, OF THE PUBLIC RECORDS
<br />OF ST. LUCIE COUNTY (NOW INDIAN RIVER) COUNTY SAID POINT BEING
<br />ALSO THE NORTHWEST CORNER OF LOT 1, BLOCK 9 OF SAID PLAT OF
<br />WEONA PARK, THENCE NORTH 0 DEGREES 16 MINUTES 57 SECONDS
<br />WEST, ALONG THE NORTHERLY PROJECTION OF THE WEST LINE OF SAID
<br />BLOCK 9, A DISTANCE OF 60.00 FEET TO THE SOUTHWEST CORNER OF
