RESOLUTION NO. 2006- 155 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, DELEGATING TO THE COUNTY <br />ADMINISTRATOR OR DESIGNEE THE <br />AUTHORITY TO EXECUTE STANDARD <br />CONTRACTS FOR CONSTRUCTION FOR FINAL <br />LIFT OF ASPHALT AND ACCOMPANYING CASH <br />DEPOSIT AND ESCROW AGREEMENTS. <br />WHEREAS, when properties are platted, the developer cannot receive a <br />Certificate of Completion for the project until all the required improvements are <br />installed, with the exception of sidewalks; and <br />WHEREAS, many projects are designed for a final lift of asphalt to be laid <br />over the minimum lift required by County Code, after the development has a majority of <br />the homes constructed and before turnover of homeowner associations so that the <br />roads are more aesthetically pleasing; and <br />WHEREAS, in order to address the developers concerns about being <br />able to obtain a Certificate of Completion prior to the final lift of asphalt being laid, and <br />to deliver a "fresh" finished development to the homeowners, developer is allowed to <br />enter into a standard form Contract for Construction for Final Lift of Asphalt to guaranty <br />the installation of the final lift and to post cash in the amount of 125% of the estimated <br />1 <br />F:\Attorney\Nancy\DOCS\RES\Reso autho admin re final lift.doc <br />
